Legal expenses

The proceedings of the Accident Appeal Board are free of charge.

According to the Administrative Judicial Procedure Act, a party to legal proceedings is obligated to fully or partially compensate the other party for their legal expenses if it is unreasonable, especially considering the decision, that the other party pay their own legal expenses. In practice, the appellant’s demands are fully or partially accepted in this case.

In evaluating the fairness of the duty to compensate, the matter’s legal ambiguity, the parties’ actions, and the matter’s significance to the interested party may be included.

Compensation for legal expenses must be demanded before the Accident Appeal Board makes its decision on the principal matter. The demand must specify the amount of and grounds for the legal expenses.

A private party may be obligated to compensate an insurance institution for its legal expenses only if the private party has presented a clearly unfounded request.
